Terms of Service

1. The Service

Sports Index is a free app for college football fans. Depending on the surface and the season, the Service includes:

• Coverage. Daily stories, the CFB Brief, trending teams and players, and team, player and game pages built from indexed public news and social sources, with AI-written summaries that cite their sources (see Section 6).
• Scores. Schedules, live scores, box scores, play-by-play and related game data supplied by third-party data providers.
• Fan identity. You plant one flag for the team you support, appear in that team's fan census and on the fan map by city, keep a daily check-in streak, and can take part in fanbase-versus-fanbase competitions.
• Games. Trivia, Drop the Pin, Picks (prediction slates scored on real results), Season Fantasy (a salary-cap roster game with weekly scoring and a leaderboard), and ballots and rankings.
• Points and the Weekly Drawing. Playing earns points. Points convert into free entries in a weekly prize drawing governed by the Official Rules at the end of these Terms.
• Discuss. Rooms where fans post takes, polls, charts and rankings, and reply to each other.

The iOS app is the primary way to use the Service. The website publishes coverage and pages for reading; during launch, signing in on the website is limited and account features are available in the app.

We change the Service often. Features, point values, game formats and competitions may be added, changed or removed at any time.

2. Eligibility

To use Sports Index you must:

• Be at least 13 years old
• Live in the United States
• Be able to enter a binding agreement, or have a parent or guardian who agrees to these Terms on your behalf

Anyone who meets these requirements can play. Claiming a prize from the Weekly Drawing has its own age requirement, set out in the Official Rules.

3. Accounts

An account needs an email address, a username and a password. You must verify your email before you can sign in. Keep your information accurate and your password private; you are responsible for everything done through your account.

One person, one account. Points, streaks, tickets and leaderboards only mean something if every account is a real fan, so you agree not to:

• Create or control more than one account
• Share your account or let anyone else sign in as you
• Impersonate another person, athlete, team, school or organization, or choose a misleading username
• Access, or try to access, an account that is not yours

We may reclaim a username that impersonates someone, infringes a trademark, or has been inactive for a long time.

4. Your content

"Your content" means everything you add to the Service: Discuss posts, replies, polls, charts and rankings, ballots, picks and forecasts, your profile photo and banner, your username, and the city and team you choose for your fan flag.

4.1 You own it

You keep ownership of your content.

4.2 The license you give us

So we can run the Service, you grant Sports Index LLC a worldwide, non-exclusive, royalty-free, sublicensable and transferable license to host, store, reproduce, adapt (for example to resize an image or render a poll), display, publish and distribute your content, and to build features from it, such as previews, share cards, leaderboards, the fan census and map, and search.

This license ends when you delete your content or your account, except that:

• Replies, quotes and shares by other people may keep referring to what you wrote
• Aggregate data that no longer identifies you, such as fan-census counts and past leaderboard results, stays in the Service
• Backups may keep a copy for a reasonable period

4.3 Public by default

Discuss posts, your username, your team, your city, your points and your standing on leaderboards are visible to other users. Your email address is never shown publicly.

4.4 What you may not post

• Anything you do not have the right to share, including copyrighted photos and video, and team or school logos you are not licensed to use
• Anything that uses an athlete's name, image or likeness in a way that violates their rights
• Defamatory, abusive, threatening or hateful content, including targeted harassment of athletes, coaches, officials or other fans
• Sexual or exploitative material
• Spam, scams, malware, or links to them
• Anything intended to manipulate polls, ballots, rankings, points or the Weekly Drawing

5. Fan identity, points and games

5.1 Your fan flag

You plant one flag for one team. Your flag places you in that team's fan census and on the fan map for the city you enter. We may limit how often a flag can be changed so that the census and territory map stay meaningful, and we may correct or remove flags planted through fake or duplicate accounts.

5.2 Points

Points are a way of keeping score inside the Service. They are awarded at the rates and daily caps shown in the app, which we may change at any time. Points:

• Cannot be bought, sold, transferred or exchanged for cash
• Have no monetary value outside the Service
• May be adjusted or removed if they were earned through a bug, multiple accounts, automation, or any other breach of these Terms

5.3 Picks, forecasts and trivia

Picks and forecasts are scored against official results as reported by our data providers. Where a game is cancelled, postponed, forfeited, or a result is disputed, we decide how the slate is scored, and our decision is final. Picks are a free game of skill and prediction for fun and bragging rights. The Service does not accept wagers and nothing in it is betting advice.

5.4 Season Fantasy

Season Fantasy is a free roster game: you build a roster under a salary cap and score points weekly from real player statistics. Rosters lock when a week's games begin and unlock after they end; swap limits and prices are shown in the app. Statistics come from third-party providers and may be corrected after the fact; scores may change when they are. Season Fantasy is not affiliated with, endorsed by, or associated with any school, conference, the NCAA, or any player.

5.5 Fanbase competitions and leaderboards

Leaderboards, fanbase matchups, territory maps and similar features rank fans and fanbases using the data the Service collects. They are provided as-is and may be recalculated when we correct data or find abuse.

5.6 The Weekly Drawing

Points convert into free entries in a weekly prize drawing. No purchase is necessary, and a Pro subscription never adds points or drawing entries. The Weekly Drawing Official Rules govern eligibility, entry, winner selection and prizes.

6. Coverage, AI-written content and third-party content

6.1 Indexed coverage

We index headlines, links, excerpts and metadata from public news and social sources and attribute them to the teams and players they cover. Attribution is automated and may contain mistakes. Linked articles and posts belong to their publishers and are subject to their terms.

6.2 AI-written content

Summaries, briefs, story recaps, trending explanations and similar text are written by artificial-intelligence systems from the indexed sources they cite, and are labeled as such where they appear. They can be wrong. Check the cited sources before relying on any claim. AI-written content is not the opinion of Sports Index LLC and is not professional, financial, betting or recruiting advice. If something is materially inaccurate, tell us and we will review it.

6.3 Scores, statistics and data

Scores, schedules, statistics, odds-style market data and similar information come from third-party providers and are shown as-is. They may be delayed, incomplete or corrected later.

6.4 Embedded content

The Service may embed or link to content from platforms such as X, YouTube, Instagram and TikTok. That content stays subject to its platform's terms, may disappear if the original is removed, and those platforms may collect data when their embeds load.

6.5 Team names and marks

Team, school and conference names, logos and colors are the property of their owners and are used only to identify the teams they refer to. Sports Index is not affiliated with, endorsed by, or sponsored by any school, conference, athletic association, league, team or data provider.

7. Notifications and email

The app can send push notifications for things like game updates, daily reminders, prompt of the day, prize drawings and replies. You choose whether to allow them and can change that at any time in the app's Settings or in iOS Settings.

We send email to verify your address, to notify you if you win a prize, and for other account matters. The daily CFB Brief newsletter is opt-in and every issue has an unsubscribe link.

8. Fees

Sports Index is free to download and use. We also offer an optional Sports Index Pro subscription, sold monthly or yearly. The price and billing period are shown before you buy. Pro currently includes following three teams plus your own, the daily CFB Brief email, live key moments for the teams you follow, player news feeds and dark mode; we may add, change or retire Pro features over time and will say so in the app.

Renewal and cancellation. Pro renews automatically at the end of each billing period at the price shown unless you cancel at least 24 hours before the period ends. Subscriptions bought in the iOS app are billed and managed by Apple: cancel any time in Settings › Apple Account › Subscriptions, and Apple's refund rules apply. Subscriptions bought on the website are billed by Sports Index through Stripe and managed from your account's billing portal on sportsindex.io. Cancelling stops the next charge; you keep Pro until the end of the period you already paid for. Deleting your account cancels a web subscription; an Apple subscription must be cancelled with Apple or it will keep renewing.

Paying never affects the game. A subscription does not add points, tickets or drawing entries and gives no advantage in any contest. Some accounts have expanded limits granted by us or by a partner (for example a team's membership program); those are a courtesy, not a purchase.

9. Acceptable use

You agree not to:

• Use bots, scripts, emulators or any automation to check in, play, post, vote or otherwise earn points or entries
• Run multiple accounts, coordinate accounts, or trade actions to farm points, tickets, votes or fanbase standings
• Manipulate polls, ballots, rankings, leaderboards, the fan census or the fan map
• Scrape, crawl or bulk-download the Service, or reverse-engineer the app or its APIs
• Interfere with the Service, probe its security, or exceed rate limits
• Harass, threaten or dox anyone, including athletes, coaches and other fans, whatever the rivalry
• Impersonate an athlete, team, school or Sports Index staff
• Use the Service for anything unlawful

10. Moderation and enforcement

We may, at our discretion and without notice:

• Remove, hide or limit the reach of content
• Reset or remove points, streaks, tickets, picks, rosters, ballots or fan flags obtained in breach of these Terms
• Disqualify an account from a drawing or competition, or void a result
• Suspend or terminate an account

We may also act to comply with the law or a valid legal request. Decisions about games, drawings and competitions are final.

11. Deleting your account and termination

You can delete your account at any time in the app: Settings, then Delete account. Deletion is permanent. It removes your profile, fan flag, points, picks, roster, ballots and Discuss posts. Records we are required or allowed to keep, such as the result of a completed prize drawing, may be retained without your name, and backups are removed on their normal schedule.

We may suspend or terminate your account for breaking these Terms, at the request of law enforcement or a court, for security reasons, or after a long period of inactivity. If we terminate your account for a breach, you forfeit any points, tickets and unclaimed prizes.

12. Intellectual property

The app, the website, our name and logo, our design, our software, our data pipelines and scoring systems, and the content we create (including AI-written content) belong to Sports Index LLC or our licensors. We grant you a limited, personal, non-transferable, revocable license to use the app and website as intended. You may not copy, modify, distribute, sell or lease any part of the Service, or reverse-engineer it, except where the law allows.

13. Additional terms for the iOS app

These Terms are between you and Sports Index LLC, not Apple Inc. ("Apple"). Apple is not responsible for the app or its content and has no obligation to provide maintenance or support for it. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; to the fullest extent permitted by law Apple has no other warranty obligation. Sports Index, not Apple, is responsible for addressing any claim relating to the app, including product liability, legal or regulatory compliance, and consumer protection claims, and for investigating and resolving any third-party claim that the app infringes intellectual property rights. You represent that you are not located in a country subject to a U.S. government embargo or designated a "terrorist supporting" country, and that you are not on any U.S. government list of prohibited or restricted parties. You must comply with any third-party terms that apply when using the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

14. Copyright complaints (DMCA)

If you believe content on the Service infringes your copyright, send a notice to our designated agent containing:

• Your physical or electronic signature
• Identification of the copyrighted work
• Identification of the infringing material and where it appears in the Service
• Your contact information
• A statement that you believe in good faith the use is not authorized
• A statement, under penalty of perjury, that the notice is accurate and you are authorized to act for the owner

Counter-notices follow the same process. We terminate the accounts of repeat infringers.

15. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that scores, statistics, coverage, AI-written content, points, rankings or drawing results are accurate, complete or timely, that the Service will be available or error-free, or that any content or feature will remain available.

16. Limitation of liability

To the fullest extent permitted by law, Sports Index LLC and its officers, members, employees and agents are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from or related to the Service. Our total liability for any claim relating to the Service is limited to the greater of $100 or the amount you paid us in the twelve months before the claim.

17. Indemnification

You agree to defend, indemnify and hold harmless Sports Index LLC and its officers, members, employees and agents from any claim, loss or expense (including reasonable attorneys' fees) arising from your use of the Service, your content, your breach of these Terms, or your violation of anyone else's rights.

18. Governing law and arbitration

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law rules.

Any dispute arising from these Terms or the Service will be resolved by binding arbitration on an individual basis, not in court, except that either party may bring qualifying claims in small-claims court. You and Sports Index each waive the right to a jury trial and to participate in a class action. If this class-action waiver is found unenforceable for a particular claim, that claim will be heard in court rather than in arbitration.

19. Changes to these Terms

We may update these Terms. When a change is material we will tell you in the app or by email before it takes effect. Continuing to use the Service after a change means you accept it. The date at the top shows when these Terms were last updated.
